User and Privacy Policy

Please review the following guidelines to assure that you comply with Marketplaces' policy of prohibited and restricted StoreFront content. Information concerning policy compliance can be found underneath the list of prohibited items.

Prohibited Items
StoreFronts may not contain the following items or content except under restrictions noted here:

• Beer, wine and other alcoholic beverages; the offering of alcoholic beverage containers of a collectable nature is allowed under the following restrictions:
  • the value of the item is clearly derived from the container and not its content
  • you divulge in the description that the container has not been opened and the contents are not intended for consumption
  • the item is not available through a retail outlet and the value of the container is greater than the current retail price of the alcohol in the container
  • you comply with any and all laws or regulations regarding the sale and sale transaction of the item
• Live animals
• Animal pelts, skins, internal organs and any other animal parts from endangered or protected species; animal pelts, skins, internal organs and any other animal parts prohibited from sale by city, state or federal laws
• Items or listings which are designed primarily to direct a buyer to a website or marketplace site other than Marketplaces or the marketplaces with which the site is integrated; however, providing a link within your StoreFront to a different website offering additional merchandise is allowed if your StoreFront is stocked and used as a primary sales channel
• Scanning receivers and radios that receive cellular transmissions or have full 800mz coverage; radio transmitting devices and related equipment which are not within regulations approved by the Federal Communications Commission (FCC); radio equipment capable of transmitting within frequency bands allocated to radio services authorized to use such frequency bands; items which interfere with police radar devices; CB radio amplifiers and CB radios which have been amplified; cordless phones not authorized for sale by the FCC
• Counterfeit paper money, coins, bank notes, bonds, money orders, securities and stamps; and equipment designed to make these items
• Stocks, bonds and other securities; investment interest in any entity or property; credit; solicitations to invest money
• Unexpired credit and debit cards; credit and debit cards with an expiration date less than 10 (ten) years old
• Narcotics, steroids and other controlled substances and drugs; items that require a prescription from a licensed practitioner
• Drug paraphernalia including but not limited to pipes, wired cigarette papers and other similar items designed to be used with narcotics or other controlled substances
• Firearms and other guns (including BB, pellet and replica guns not adhering to federal laws), ordnance, grenades and the like, ammunition and certain other related materials including but not limited to silencers and automatic kit converters; some toy-type guns may be permitted
• Fireworks and other pyrotechnic devices
• Government issued identification documents including but not limited to driver licenses, passports and birth certificates; applications for such items; similar articles designed to resemble such items
• Current vehicle license plates and those less than 10 years out-of-date; items designed to resemble such plates
• Items designed primarily to be used to manufacture or alter identification documents, licenses or plates.
• Clothing, identification and equipment relating to transportation or other security entities, unless the item is more than 10 (ten) years old, no longer in use and does not resemble similar items still in use by the security entity; clothing, identification and equipment designed to portray that of any transportation or security entity
• Items relating to mass commercial public transportation which would not normally be available to the public, including but not limited to documents, manuals and correspondence
• Humans and any human body parts excluding some items that may include human hair (such as lockets)
• Locksmithing tools and/or materials including but not limited to lockpicking devices, key cutting tools and devices
• Lottery tickets
• Event ticket listings which do not conform to local, state or federal law, restrictions or regulations
• Email or mailing lists; tools or software designed primarily to send unsolicited email; personally identifying information including social security numbers, names, addresses, phone numbers and other related information, and items that contain the same.
• Plants and seeds prohibited from sale by state and federal law.
• Postage meters
• Items recalled by the U.S. Consumer Products Safety Commission (CPSC) including but not limited to lawn darts, defective baby cribs, infant carriers and car seats, and propane heaters.
• Items designed primarily to be used to descramble or facilitate access to cable or satellite television programming without authorization or payment; information that describes how to or encourages such activity
• Stolen property
• Items designed primarily to record a conversation without the knowledge or permission of those involved in the conversation; photographic devices designed primarily to view and record individuals for sexual purposes without the individual(s) knowledge or permission
• Cigarettes, cigars, pipe tobacco, chewing tobacco; the offering of tobacco packages/containers of a collectable nature is allowed under the following restrictions:
  • the value of the item is clearly derived from the package/container and not its content
  • you divulge in the description that the package/container has not been opened and the contents are not intended for consumption
  • the item is not available through a retail outlet and the value of the package/container is substantially greater than the current retail price of the tobacco in the package/container
  • you comply with any and all laws or regulations regarding the sale and sale transaction of the item
• Items that violate or infringe on the trademarks and/or copyrights of entities that own the respective trademarks and/or copyrights including but not limited to: duplicated musical recordings, films, photographs, television shows, software and games; academic and original equipment manufacturer (OEM) software; promotional and pre-release items; recordings of live events and concerts; fake autographs
• Some hand weapons including but not limited to metal knuckles, throwing stars and blackjacks; switchblade, trigger and automatic blade-released knives with blades longer than two inches and knives designed to look like a different item; metal replicas of such weapons
• Artifacts, natural cave formations and grave-related items protected under various federal laws; items from historical graves, including but not limited to tombstones, markers and related items
• Batteries that contain mercury
• Non-transferable items and other items prohibited from sale by contracts, including but not limited to some types of tickets, software and equipment
• Freon and hazardous and/or dangerous goods such as explosives, radioactive materials, flammable gases and solids, and toxic substances
• Titles, descriptions and images containing profanity
• Descriptions and images portraying sexual acts and human genitalia
• Items, titles, descriptions and images portraying, attempting to portray or referring to child pornography, sexual activity or content of a sexual nature involving a minor
• Items, titles, descriptions and images portraying graphic violence
• Items consisting of, or including any bodily fluids
• Videos from hidden cameras showing sexual activity or content
• Videos showing images of amateur sexual activity or content
• Items, descriptions and images portraying necrophilia
• Items, titles, descriptions and images portraying bestiality, rape sex, incest, or sex with graphic violence or degradation
• Titles and descriptions describing an item as XX, XXX or above
• Items, titles, descriptions and images which are considered obscene within your local community
• Links to any site that contains adult/mature items, descriptions or images prohibited on your Marketplaces StoreFront
• Used under garments including but not limited to panties, thongs, bras, briefs, boxer shorts, boxer briefs and athletic supporters
• Items, titles, descriptions and images which attempt to glorify hatred, violence, or racial intolerance, or items that promote organizations with such views
• Pesticides not allowed for sale by the Environmental Protection Agency and/or other federal or state agencies or statutes
• Law enforcement or quasi-law enforcement badges; official or quasi-law enforcement equipment from any public or government entity
• Items which are not currently in the possession of the seller and cannot be obtained and shipped by the seller within 30 (thirty) days subsequent to the sale of said item
• Slot machines and all other gambling devices not allowed for sale by your local, your state or federal law
• Used clothing, shoes or accessories which have not been cleaned
• Medical devices that have not been cleaned or handled in accordance with manufacturer's instructions; medical devices not provided with the original box, labels and all instructions from the manufacturer
• Items which represent the unauthorized use of a person's name, likeness or signature
• Items prohibited from sale by contractual obligation
• Items prohibited by importing laws or regulations; items restricted from importing by laws or regulations
• Items prohibited from sale by your local, your state and federal law; any and all items that do not comply with regulations of your local, your state or federal agencies.

Additional Prohibitions and Restrictions
Some items not listed above may be prohibited or restricted by local, state, federal and/or international laws or regulations. Additionally, while Marketplaces may allow certain items to be offered in your Marketplaces StoreFront, there may be local, state, federal or international laws or regulations that restrict the sale of the item to certain individuals, or to individuals within certain countries. It is your responsibility as the seller to be aware of any and all laws or regulations governing the offering and/or sale of your inventory items. Marketplaces cannot and will not inform you of the applicable statutes.

Policy Compliance
If we determine that your StoreFront contains prohibited or restricted items, your cooperation will be requested to remove the offending item(s) immediately and agree to desist from offering the item(s) or similar item(s). If our request is not complied with, your Marketplaces account will be suspended. If you continue to offer prohibited or restricted items in your StoreFront, your Marketplaces account may be closed permanently without further notice.

Marketplaces may amend these guidelines at any time without further notice.
